The guy who poisoned the trees is a moron. Not only is it messed up but he pretty much just told the whole world where to find him..idiot.

Been a few since I posted here, but I've continued lurking.

Ever since I heard about his phone call last month, I've been giving the rednecks the benefit of the doubt that no one could seriously take the rivalry this far. Even a member of the agricultural staff said that he didn't see anything abnormal based on the reading he was finding. I just wrote it off as some douchebag trying to get a few laughs and maybe gain cred as a radio personality.

Lo and behold, any and all respect I've retained for these fans has been thrown out the window. I've seen plenty of garbage posted by these classless pricks in the past, but the fact that they find it hilarious and are reveling in it is disgusting.

Thanks to those expressing sympathy and understanding that this is absolutely devastating to our community. Our campus may not be the same for a long time to come.

This is a truly horrible act for someone to do. It's literally harming everyone's chance to experience a piece of history - the tree was planted just years after the Civil War. Reminds me of an article I read explaining that one of Obama's cabinet members wrote a legal article back in the 70's, I think, that argued that trees should have standing to sue people in court who harm them (through representation, much like someone who represents a minor or a decedent). At least there are laws that the justice system will be able to prosecute this dirtbag under.

Update on Updyke.
OPELIKA, AL (WSFA) - The man accused of poisoning two historic oak trees on the campus of Auburn University is now facing federal criminal charges.

Attorney Glennon Threatt, Jr, attorney for accused Toomer's Corner tree poisoner Harvey Updyke, Jr. says his client, Harvey Updyke, has been indicted on 6 federal charges.

He was already facing felony Criminal Mischief 1st Degree felony charges at a local level.

Threatt is going through the counts at this moment.

It appears federal prosecutors are charging Updyke with 2 counts of Criminal Mischief, 2 counts of Desecration and 2 counts of destruction of federal property.

WSFA 12 News will have more information as it becomes available later this evening.

Both trees on Toomer's Corner, considered century-old landmarks, are starting to show serious signs of poisoning.

The guy is dumb and deserves to be punished. But, stacking up a bunch of federal crimes for poisoning a couple trees that might not even die is over-kill, imo.

It appears the story of federal charges is false.

An already bizarre story has taken yet another head-scratching twist as reports from Tuesday night that reportedly emanated from Harvey Updyke‘s attorney have now been shown to be false.

Here’s a piece of the report published last night by Evan Woodbery of the Birmingham News regarding Updyke, who is facing state charges for allegedly poisoning Auburn’s Toomer’s Corner oaks late last year.

Harvey Updyke now faces federal charges related to the poisoning of oak trees at Toomer’s Corner in downtown Auburn, his attorney tells WSFA.



His attorney, Glennon Threatt of Birmingham, told WSFA in Montgomery that Updyke now faces six additional federal charges. Threatt did not provide details and had not yet returned calls.

Wednesday morning, the Opelika-Auburn News has reported that the story whose genesis was apparently on the Birmingham television station has been determined to be incorrect. Instead, the News writes, “a Lee County (Ala.) grand jury has indicted the Alabama fan accused of poisoning the Toomer’s Oaks sometime after the 2010 Iron Bowl on multiple charges, including criminal mischief and the desecration of a venerated object.”

According to court documents, the grand jury indicted Harvey Updyke Jr. on two counts of first-degree criminal mischief, a felony charge; two counts of desecrating a venerated object, a misdemeanor charge; and two counts of unlawful damage, vandalism or theft of property from a farm animal or crop facility, a felony charge.

An arraignment has been scheduled for May 26, with a tentative trial date of June 20. And then, hopefully, within a week or so we’ll never again have to type the name “Harvey Updyke”.

It remains unclear, incidentally, how the erroneous report regarding federal charges originated in the first place.

Hard to believe that the Department of Homeland Security would be interested ;)...

He hasn't shown very good judgement in any of his other decisions, why should choosing an attorney be any different? :lol:
