I believe this more than the aunt scenerio. None of it matters though because nothing he said could warrant
Blounts temper tantrum after the punch. Even if it could then the blame should be laid on Kelly for allowing a player suffering from so much distress and instabilility to be placed in that scenerio before they can emotionally cope with their loss. I really like Blount as much as the rest of you guys but I thought the mid west had the market cornered on the gossip and excuses for this kind of thing. He messed up and he knows it. He now knows the punishment and has a choice to make the best of it. In an ideal world he would even finish his degree and keep working out but it will be his choice.
I also don't understand all this stuff about Peterson, in every interview I have seen he has downplayed what Blount did while trying to downplay the incident. I think that Oregon is boise state coaches 2nd favorite team and they are trying to protect Oregons image not hurt it. For those of you that think what Hout did was so bad I hope you never find out what happens at the bottom of 80% of dogpiles especially if the ball carrier didn't land with the ball under him. I fear you might quit watching football.

Yeah on the bottoms of dog piles things are said.....and punches, kicking, pinching, spitting and everything else goes on. I think it's undisputable that without Hout's taunting this event never takes place.

I don't argue that at all. In a perfect world Blount should have been able to walk away and I am sure he wishes he would have. I personally would not have held it against him if he could have left it at the punch. Everything after that was just Blount losing it.

Traydub and Monster you guys have gone into outerspace on this debate. Its a football game and If Hout pressed charges he would be laughed at for years and calling the shoulder bump assault is comical

I didn't say he should be charged with assault, but he definitely could. You guys have no concept of what assault means.

And Blount isn't lucky, but he sure as hell isn't unlucky. He brought all this on himself.

we know what assault is. 90% of what happens on the football field would be assault outside of it. The day after the game these guys are feeling more pain than 90% of assault victims. this comparison should never have been brought up

I hear you. I just don't place much difference between different words for the purpose of determining punishment. Obviously, saying some things are a lot more offensive than others. But, I don't know how you decide how many games of suspension different words are worth. To me, the bottom line is that he violated Blount's physical space by striking him on the shoulder and made a comment intending to belittle him after the loss. Whatever he said, it's worth a one game suspension in my opinion.

I also think that it has been poorly handled by BSU. If they admit that they don't support it, shouldn't part of their internal process be to encourage Hout to publicly apologize for his role as Blount did?

Very well said. I agree completely. An indefinite suspension would have been appropriate and accepted by the majority of the public.

The punishment levied was a knee-jerk reaction to the first wave of hysteria. By the time it was announced, a more nuanced perspective of the event was already making it's way to the surface nationally. Eventually, the players and recruits are going to do the math too.

I think that Peterson is downplaying it because what matters to him is that they won the game. Hout wasn't hurt. They, as all football programs do, see punches exchanged in practice and games from time to time. So, why would he care that much that Blount punched his guy for spouting off in an emotional circumstance? Like he said, sometimes things get heated.

Assault is the threat of and battery is the carrying out of any offensive contact. What Hout did absolutely could be pursued legally.

Offensive contact hasn't ever been interpreted broadly enough to cover a shoulder tap. You can't just put some ambiguous term you found in an online legal dictionary in bold and try to say that that makes a shoulder tap (and, apparently, every time anyone touched someone else ever) battery. Offensive contact is much more limited than that. Sorry, but you sound ridiculous.

Actually, it's pretty obvious not all of us do. And both of those "statistics" are completely irrelevant. Blount hit someone after the game was over. Then he hit someone else. Then he tried to go hit some more people, though thankfully he was restrained first. That's a bit different than normal gameplay.

Sorry, but you sound ignorant of the law.
A battery is an intentional physical contact with a person without his or her consent that results in bodily harm or is offensive to a reasonable sense of dignity. An act is a battery if it causes physical pain or injury to a person's body. It may also be an act that is offensive to a reasonable person. Ordinary bumping that occurs while walking through a crowd is generally not offensive to a reasonable person; however, intentionally pushing people in a crowd out of the way may be offensive to a reasonable person. In addition, a defendant may be liable if he or she commits an act that would not be offensive to a reasonable person but that offends a sensitive plaintiff, whom the defendant knew to be a sensitive person. The defendant need not actually touch the plaintiff using his or her body; the contact may be caused indirectly. Contrary to your unsupported assertion, the definition of battery includes what Hout did. It is perfectly reasonable of a person to be offended by someone slapping them on the shoulder.

Let me know if you need additional sources that demonstrate beyond all doubt that what Hout did does fall under the definition of battery.

A reasonable person would not consider getting tapped on the shoulder to be assault. Hout showed no intent to harm Blount, only to get his attention (so that Hout could mouth off and be a douchebag). If you want to win this argument, you need to show me a precedent where offensive contact has been interpreted THAT broadly. Hint: you won't be able to, because it's never happened. Once again, simply bolding a line or two that doesn't support your argument doesn't make you right.
