Has anyone here dealt with this. I have a client that gave me a letter that he received back in may and claims he doesn't owe it. After doing a little research I found out that a lot of people were having problems.

I'm not asking for legal advice of course, prescription has ran on their claim so I'm going to simply call and ask them to pull his name out and send us a letter stating that he has been cleared, but I was just curious if any of you have dealt with these people.

Is Hollywood Video trying to collect the debt or any outside agency? You are only required to repay your original debtor.

Tell your client to send a letter to to Hollywood Video asking for validation of the debt. This requires the creditor to provide a copy of the original contract, account agreement, or whatever is the basis for the alleged debt.

P.S. What sort of 'client' do you have that brings you collection letters for overdue video rentals?

P.P.S. What Duck07 said is not true. Contracts, including debt, can be transferred by assignment. Debt is still valid and you have to pay the holder of the obligation.

Thought I replied to this a long time ago…anyway…their “legal successor” is attempting to collect the debt, which would be legit if he owed it.

None of that is necessary here, you can’t attempt to collect a rental fee in Louisiana after 3 years.

The kind that brings me so much work he knew that if he brought this to me I would handle it for free.

Correct, there are some laws in certain states that may make some circumstances funky but all of them recognizes "legal successors"

We had a collection notice right before Hollywood Video closed in Portland. It was completely bogus as we hadn't rented anything from them for years and our balance with them was zero when we had stopped using them. I don't remember much of the details other than I stopped at the store, they indicated this was going on a lot and took care of it at the store level, no further collection attempts after that.

I suspected they were trying to milk their customer database in a swan song. With no goodwill to lose, as they were closing, they sent out phony bills to see who would blindly pay and who would question it, dropping the collection efforts on those those that called them on it.
